This is held by the Landlord and is the amount you can expect to be returned to you at the end of your tenancy. The bond will be repaid at end of tenancy subject to rent being up to date, key returned, and room left clean and undamaged.  The bond refund will be paid by direct credit to your nominated bank account within 10 business days from the date of your departure, or date that you notify us of your bank account details, whichever is the later. 

Rent is payable up to and including the last day of the tenancy, regardless of the time of departure.

Room inventory and inspection


The Landlord and Tenants agree that


  1. This boarding house tenancy agreement is governed by the Residential Tenancies Act 1986.
  2. This boarding house tenancy is intended to last for 90 days or more.
  3. The Tenants agree to abide by the House Rules.
  4. The Tenants shall give the Landlord at least 48 hours’ notice of termination of the tenancy. Notice should be given by email or text message where possible.
  5. Rent is payable up to and including the last day of the tenancy, regardless of the time of departure. Tenants will be liable for rent on the room until the room is vacated and left clean and tidy and the keys have been returned.
  6. The boarding room that the Tenants are renting is not shared by other tenants.
  7. The Tenants shall not assign or sublet the tenancy.
  8. Notices may be given by email or text message to any of the email address(es) and phone number(s) on this agreement (or such other number as notified by the Tenants to the Landlord from time to time).
  9. The bond is equal to one week’s rent. This is held by the Landlord. The bond will be repaid at end of tenancy subject to rent being up to date, key returned and room and chattels left clean and undamaged.  Unrecovered damages, penalty fees and rent arrears may be recovered from the bond at the end of the tenancy.  The bond refund will be paid by direct credit to the Tenants’ nominated bank account within 10 business days from the date of departure, or date that the Tenants notify the Landlord of their bank account details, whichever is the later.   
  10. The Landlord may repay any bond payable to any one of the joint Tenants as the Landlord in its sole discretion shall decide and such repayment shall discharge the obligation of the Landlord in respect of both Tenants.
  11. If the tenancy of only one joint Tenant ends, the bond and any rent paid in advance will be transferred automatically to the remaining Tenant and such transfer shall discharge the obligation of the Landlord in respect of the departing Tenant.
  12. Payments must be made by automatic payment or direct deposit to the Landlord’s nominated bank account on or before the due date for each payment. No other payment method will be accepted.
  13. Power and water are supplied by the Landlord and covered by rent.
  14. Washing machines and dryers are available at a cost. These are coin operated, payable by the Tenant. Washing machines and clothes dryers are available for use by the Tenant only.  The Tenant undertakes to use these facilities only for their own private and personal use and will not permit any person who is not a tenant to utilise the laundry facilities at the property, nor offer the laundry facilities to any friends and family.
  15. The Landlord will take reasonable measures to provide wireless internet to the Tenants. Where internet is available, this may be provided by way of free access through a hotspot system limited at the discretion of the landlord. Breach of copyright and internet piracy will not be tolerated and will be grounds for termination of this agreement.
  16. The Tenants are solely responsible for all subscriptions and other charges relating to the use of any smart television or other devices provided on the premises and each Tenant will ensure that their username and passwords are deleted from the relevant device. The Landlord is not responsible for any charges, liability or loss arising from the failure of the Tenant to delete their username and passwords from the device.  The Tenant will not download any pirated or objectionable material or infringe any copyright laws when using any device provided by the Landlord.
  17. The Tenancy address may not be used as a bail address or for parole or home detention. If a Tenant is on parole or is placed on bail or home detention, the tenancy will immediately terminate.
  18. If a Tenant is arrested for, charged with or convicted of: burglary; theft; assault; or any other offence punishable by a term of imprisonment, this will be grounds for immediate termination of the Tenancy.
  19. Tenancy details may be provided to the police as part of their crime prevention programme applying to boarding houses. By signing this agreement, you agree to release your details for this purpose.
  20. Fire evacuation procedures are appended to this agreement and displayed around the building. By signing this agreement, you acknowledge that you have understood the procedures.
  21. In case of fire alarm activation, the Landlord or its agent will be permitted to access your room without prior notice at any time of day within a reasonable time following the alarm to determine the cause of the alarm.
  22. The Tenants may be charged for any costs relating to a false fire alarm activation which occurs because of tampering with smoke detection devices or from smoke in the Tenant’s room.
  23. Damage to property caused by a Tenant or the Tenant’s guests and visitors will be charged to the Tenant. If the Tenants or their guests or visitors cause damage because of careless behaviour, the Tenants will be liable for the cost of the damage up to four weeks’ rent or the insurance excess, whichever is lower.  The Tenants will be liable for the full cost of damage that they or their guests or visitors cause intentionally or that results from an act or omission that constitutes an imprisonable offence.
  24. Failure to pay amounts due under this agreement may result in debt enforcement action. All costs incurred in relation to such debt enforcement action will be the responsibility of the Tenant.
  25. Unless otherwise specified, no car parking is provided with this tenancy. Tenants are not to park in any carpark that is not allocated to them. Tenants shall ensure that their guests and visitors do not use carparks that are not allocated to them.
  26. Tenants shall notify the Landlord of any change in their car registration details, regardless of whether parking is provided.
  27. Supplied furnishings and chattels are to be maintained in good condition by the Tenants. Furniture supplied by the Landlord is to remain in your room. No private furniture, (including mattresses) is to be brought into the property, unless otherwise agreed in writing. 
  28. Mattress protectors are supplied by the Landlord and are to be used at all times.
  29. The Tenants will not paint or make any alterations to the rooms. The Tenants will not attach anything to the walls without the Landlord’s prior written consent.
  30. Bicycles are not to be left in hallways or internal communal areas.
  31. Hazardous materials, including chemicals and corrosive or explosive materials must not be used or stored on the property by any Tenant.
  32. The Landlord may arrange pest control treatments as necessary from time to time. Pest control methods will be limited to chemicals that are permitted by law and which comply with New Zealand standards, as applicable.
  33. Tenants must not go onto the roof of the property for any reason. This is for their own safety and to avoid damage to the building.
  34. Tenants are not permitted to conduct any business, that involves customers or clients visiting the premises or regular deliveries or pick-ups, from their room or any other part of the property, except with the prior written permission of the Landlord. Remote working that does not otherwise impact on other tenants is allowed.
  35. Tenants are responsible for the actions of their visitors and guests and any damage they might cause. The Tenants may have a guest to stay overnight in their room for a maximum of two nights per week.  Extended visits are not permitted, and residents must not allow any other person to reside in their room or the communal areas.  Guests are not to be given a room key.  Any person wishing to have a guest stay for more than two nights per week will need to apply to the Landlord to have the guest added as a tenant on their tenancy agreement.
  36. The Landlord assumes no responsibility for the personal property of residents and their guests. Tenants should maintain insurance protection against loss and damage to or theft of their personal property.
  37. The Landlord shall not be liable for any damages or theft of property arising in respect of any car park provided.
  38. Weapons (sword/knives etc) or firearms, including but not limited to air rifles, BB guns, archery equipment, slingshots, crossbows, replica firearms or toy guns that may be mistaken for genuine firearms, are prohibited on the property at all times.
  39. The Tenants agree to be vaccinated against COVID-19 prior to the commencement of this tenancy.  Where the Tenant has only had a single dose of the vaccine, the Tenant agrees to ensure that they obtain the second dose as soon as reasonably practicable.  The Tenant agrees to obtain any subsequent booster shots of the COVID-19 vaccine as recommended by the Government of New Zealand, if and when these become available. The Landlord may ask to see evidence of vaccination.

WEST TERRACE LODGE – HOUSE RULES

The house rules form part of your tenancy agreement and are conditions of occupancy. The landlord may change the house rules with seven days’ prior notice. Failure to abide by the house rules will be a breach of your tenancy agreement and the landlord may issue you a notice to terminate your tenancy.

  1. Consideration: Please be considerate and respect the landlord’s property and your fellow tenants and their belongings at all times.
  2. Cleanliness: It is your responsibility to clean up your own mess. Bathrooms, toilets, shower rooms, kitchen and any communal facilities must be left clean and tidy after use. In particular:
    (a) Pots, pans and other cooking utensils must be cleaned and put away after use. Food items left out and/or not stored hygienically will be disposed of immediately.
    (b) You must keep your room in a sanitary state.
  3. Visitors: All visitors must leave the property before 10pm. Additional rules relating to visitors to the property may be made by the Landlord with immediate effect in response to COVID-19 Alert Level settings.
  4. Smoking: No smoking indoors. This includes vaping. Please be respectful of other tenants when smoking outside.
  5. Alcohol: The following rules are designed to ensure that the tenants have quiet enjoyment of the property, free from intimidation from others:
    (a) No visitor may consume alcohol on the premises.
    (b) Any social gatherings must end by 10pm.
    (c) Excessive drinking is not permitted anywhere on the premises.
    Failure to abide by these rules and any abusive or uncooperative behaviour will not be tolerated and may result in the immediate termination of your tenancy agreement.
  6. Drugs: No drugs, including synthetic drugs, or drug paraphernalia may be kept or used on the premises. Your tenancy agreement may be cancelled with immediate effect if you use or are in possession of drugs or drug paraphernalia on the premises.
  7. Damage: Any damage to the landlord’s property should be reported to the landlord immediately. If you break or otherwise damage any property deliberately or due to your own negligence or recklessness, you will be charged for the cost of repair or replacement. All such charges are due immediately.
  8. Fire Safety: No stove-top cooking, candles or open flames are permitted in your room. You will be responsible for paying any charges relating to fire service call outs caused by you, including by smoking in your room. Do not interfere inappropriately with any fire safety equipment or smoke detectors on the property. Your tenancy agreement may be cancelled with immediate effect if you tamper with such equipment. Defective fire safety equipment should be reported to the landlord immediately.
  9. Pets: Pets are not permitted on the property unless authorised by the Landlord.
  10. Vaccination COVID-19: All tenants of West Terrace Lodge must be vaccinated against COVID19. The landlord may  ask to see proof of vaccination.

The required heating capacity for the main living room of West Terrace Lodge (House) is 4.4kw.

The type of qualifying heater being installed in West Terrace Lodge main living room is a 4.3 kw heat pump.

The type of qualifying heater being installed in the West Terrace Lodge (House) is a 6kw heat pump.

Power is included in your rent.


WEST TERRACE LODGE – HEALTHY HOMES STANDARDS CURRENT LEVEL OF COMPLIANCE

This Healthy Homes Statement is provided pursuant to section 13A of the Residential Tenancies Act 1986, the Residential Tenancies (Smoke Alarms and Insulation) Regulations 2016 and the Healthy Homes Standards as required by section 66I(1)(bb) of the Residential Tenancies Act.  It forms part of your tenancy agreement.

West Terrace Lodge will comply with the Healthy Homes Standards as required by section 66I(1)(bb) of the Residential Tenancy Act.

The Healthy Homes compliance date for this tenancy is 1 July 2021.

Extractor Fans
West Terrace Lodge meets the ventilation standard relating to extractor fan requirement in the kitchen. The kitchen has a 250mm extractor fan.

The bathrooms have opening windows.


Moisture Ingress and Drainage Standard

West Terrace Lodge has gutters and downpipes that efficiently drain storm water, surface water and ground water to an appropriate outfall.

The West Terrace Lodge (house only) has an enclosed subfloor space.  A ground moisture barrier is not installed.  There is limited space under the house and a professional installer has advised that it is not reasonably practicable to install a ground moisture barrier.


Draft Stopping Standard

West Terrace Lodge does not have an open fireplace.

West Terrace Lodge is free from unintentional and unreasonable gaps or holes in the doors, windows, walls, floors, and ceilings that allow noticeable draughts in or out of the building.

WEST TERRACE LODGE - INSURANCE STATEMENT

WEST TERRACE LODGE has been insured by Chubb Insurance New Zealand Limited, as arranged by the building owner.

The excess amount applying to material damage to the property is $500. 

The insurance policy for this property is available for the tenant if they request it. This ensure that the tenant knows what actions or omissions could invalidate the insurance policy and also helps the tenant to know what is covered by insurance and the excess payable on the insurance policy. 


WEST TERRACE LODGE - FIRE EVACUATION SCHEME

2 - 6 WEST TERRACE & 382 KARANGAHAPE ROAD, AUCKLAND


IF YOU DISCOVER A FIRE:

Activate the nearest fire alarm.

  • Phone the Fire Service, dial “111”.
  • Evacuate the building using the nearest safe fire exit.
  • Use fire-fighting equipment only if no danger is involved.
  • Do not use water extinguishers or fire hoses on fires involving electrical equipment.
     

IF THE ALARM SOUNDS:

  • Evacuate the building immediately using the nearest safe fire exit.
  • Do not linger to collect personal belongings.
  • Make sure that all other occupants in your area evacuate too.
  • Assist any persons with disabilities.
  • Do not carry food or drinks when evacuating.
  • Proceed to the assembly areas under the bus shelter in Karangahape Road.
  • Do not re-enter the building until the Fire Service has given the “All Clear”.

BUILDING WARDEN QUICK REFERENCE:

  • The first tenant to exit the building puts on the Building Warden’s red vest, collects the evacuation checklist and goes to stand on the corner of Karangahape Road and West Terrace.
  • Delegate someone to make a “111” call.
  • Receive reports from Residents, record them on the evacuation checklist.
  • Meet and liaise with the Fire Service.
  • Direct occupants and visitors to move along Karangahape Road away from the building.

RESIDENTS QUICK REFERENCE:

  • Ensure all occupants evacuate your room.
  • Report clearance of your room to the Building Warden, on the Corner of Karangahape Road and West Terrace.
  • Inform the Building Warden of any people left in the building, specify their reason for remaining.

AS PART OF NORMAL ROUTINE PLEASE ENSURE THAT:

  • Exit doors and corridors are kept clear of obstacles at all times.
  • Exit doors leading to exit ways are not locked, barred or blocked as to prevent occupants from leaving the building and doors can be easily opened from the inside without the means of a key.
  • Smoke control and fire stop doors are kept closed at all times unless fitted with “hold open devices” which comply with the building code.
  • Stairways and passageways that are designed specifically for means of escape from fire are not used as places of storage or places where refuse is allowed to accumulate.
  • Flammable liquids or materials are not stored near, or within, any part of the building used as a means of escape from a fire.
  • The manual fire alarms call points (the red break glass, operate switch boxes) and fire extinguishers are not obscured or obstructed in any way.
